TERMS AND CONDITIONS OF THE ONLINE STORE

The online store operating at www.beesblooms.eu is managed by MATHILDE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office in Kołobrzeg, at ul. Witkowice 1, 78-100 Kołobrzeg, entered into the National Court Register (KRS) kept by the District Court in Koszalin, 9th Commercial Division of the National Court Register under KRS number: 0001182819, NIP (Tax ID): 6711867819, REGON: 542199358, hereinafter referred to as the "Seller".

§ 1 GENERAL PROVISIONS

1. Definitions:

  • TERMS AND CONDITIONS – these terms and conditions.
  • CLIENT – a natural person, legal person, or an organizational unit without legal personality but with legal capacity, who places an Order in the Online Store under the terms specified herein.
  • ENTREPRENEUR WITH CONSUMER RIGHTS – a natural person who is an entrepreneur entered into the CEIDG register, placing an Order as part of their business activity, but not related to the professional nature of that activity. This status applies only to clients with a delivery address or registered office in Poland.
  • CONSUMER – a Client who is a natural person using the Online Store for purposes not directly related to their commercial or professional activity.
  • GOODS/PRODUCT – a movable item presented in the Online Store, which is the subject of the Sales Agreement.
  • SALES AGREEMENT – a contract for the sale of Goods within the meaning of the Civil Code, concluded between the Seller and the Client via the Store’s website.
  • ONLINE STORE (STORE) – the website available at www.beesblooms.eu, through which the Client may place an Order.
  • ORDER – a declaration of the Client's will clearly defining the type and quantity of Goods, aimed directly at concluding a Sales Agreement.

2. The Store's activity includes the sale of products currently in its assortment and enabling the Client to place Orders via the website. Using this service is possible after registration and logging in or via a correctly filled-out Order form without the need to log in. Browsing the assortment on product pages is free of charge.

3. Sales take place via the Internet between the party placing the Order (Buyer) and the Store (Seller).

4. Every Client purchasing products offered by the Store is obliged to read these Terms and Conditions.


§ 2 TECHNICAL REQUIREMENTS FOR PLACING ORDERS

1. Technical requirements necessary to use the Store's services:

  • Internet connection,
  • A correctly configured web browser,
  • An active and correctly configured email account,
  • Enabled Cookies and JavaScript support,
  • Software for reading PDF files.

2. If the Client uses equipment or software that does not meet the technical requirements above, the Store does not guarantee the correct functioning of the website and reserves that it may negatively affect the quality and process of placing an Order.

3. The Client is prohibited from providing unlawful content, including in Product reviews.

4. The Store ensures that all reviews of Products come exclusively from Clients who purchased the given Product. To this end, access to the rating form is limited to registered Clients with a recorded purchase history of the item, or guest Clients who receive a unique link via email after purchase.

5. Clients may subscribe to the Newsletter. Unsubscribing is possible at any time via email (info@beesblooms.eu) or the "unsubscribe" link in the message.


§ 3 REGISTRATION

1. Registration in the Store is free and optional.

2. Registration requires filling out a form (name, email, password), accepting the Terms and Conditions, and consenting to data processing for Order fulfillment. A confirmation email will be sent to complete the process.

3. Logging in is done using the data provided during registration. Registration can also be performed via Facebook or Google account integration.

4. To delete an account, send a request to info@beesblooms.eu. Account deletion occurs after all pending Orders are fulfilled.

5. Guest checkout (without registration) is permitted. The Client must provide necessary data (name, email, phone - optional, delivery address) and accept the Terms and Conditions.


§ 4 ORDERS

1. Information about the assortment constitutes an invitation to conclude a contract (Art. 71 of the Civil Code).

2. The Order process begins on the product page. The Client is informed of fulfillment times, availability, price, and payment/delivery methods.

3. Confirmation of Order receipt sent by the Store constitutes acceptance of the invitation.

4. Business clients must provide a NIP (Tax ID) during checkout; otherwise, they are treated as Consumers.

5. If a Product is unavailable, the Store will notify the Client within 14 days. The Client may then choose to wait, cancel the entire Order, or fulfill only the available part.

6. The maximum order fulfillment time is 21 business days.


§ 5 PRODUCT PRICES AND PAYMENT METHODS

1. The price at the time of placing the Order is binding. Prices include VAT (if applicable based on delivery location) but exclude delivery costs.

2. Delivery is carried out via courier companies. Delivery costs are provided before the Order is finalized.

3. Available payment methods:

  • Traditional bank transfer,
  • Electronic payments and credit cards (DotPay/Przelewy24/AutoPay),
  • Deferred payments (PayPo, Alior Bank Installments),
  • PayPal,
  • Cash on delivery (depending on courier capabilities).

4. If payment (other than Cash on Delivery) is not received within 14 days, the Order will be canceled.

5. Order fulfillment begins after payment confirmation is received from the payment provider.


§ 6 COMPLAINTS (WARRANTY)

1. The Store is obliged to deliver goods without defects and in accordance with the Agreement.

2. The Store is liable for any lack of conformity of the Goods with the contract existing at the time of delivery and discovered within the statutory periods.

3. In case of defects, the Client may request repair or replacement. If repair/replacement is impossible or too costly, the Client may request a price reduction or withdraw from the contract (refund).

4. Complaints should be sent electronically or in writing. The Store will respond within 14 days.

5. Transport of complained goods under the warranty is at the Store’s expense via a specified shipping method.


§ 7 RIGHT OF WITHDRAWAL (RETURNS)

1. Consumers and Entrepreneurs with Consumer Rights have 14 days to withdraw from the contract without giving a reason.

2. To meet the deadline, send a statement (written or email to info@beesblooms.eu) before the 14-day period expires.

3. Exceptions: The right to withdraw does NOT apply to:

  • Non-prefabricated goods made to the consumer's specifications or clearly personalized (e.g., custom-colored sofas).
  • Goods that are inseparable from other items after delivery.

4. Returned Goods must be sent back within 14 days of withdrawal to the warehouse: ul. Witkowice 1, 78-100 Kołobrzeg. The Client bears the direct cost of returning the item.

5. The Store will refund all payments, including original delivery costs, within 14 days of receiving the withdrawal statement, though the Store may withhold the refund until the Goods are received back or proof of shipment is provided.


§ 8 FINAL PROVISIONS

1. A VAT invoice or other settlement document is issued for every sale and delivered electronically (acceptance of these terms constitutes consent).

2. Polish law applies. Any disputes involving Consumers will be resolved by the court competent under civil procedure rules.

3. The Seller reserves the right to change these Terms and Conditions. Registered Clients will be notified via email 14 days in advance.
